Presidential Decree No. 58 on some arrangements for the protection of property rights in the process of expropriation of land plots for public needs.

The President decrees that land plots can be allotted by local self-government for public needs exclusively after expropriation thereof from former land tenant, landowner, landlord or lessee in accordance with legislation on protection and tenure of land and the provisions of this Presidential Decree. Unjustified expropriation of land plots shall be prohibited. In case of expropriation of land plot the person allotted land plot expropriated for public needs shall compensate damages and losses to the former landowners or land tenants.

Ministerial Decree No. 1736 implementing Presidential Decree No. 671 on certain aspects of expropriation and allotment of land.

This Ministerial Decree sets forth the procedure for carrying out tenders for land lease contracts for construction following a local decision authorizing the expropriation and allotment of land. Any legal person, individual entrepreneur or foreign legal person shall be authorized to participate in the tender. Damages resulting from the expropriation of land shall be compensated; amounts shall be based on: (a) the value of removed buildings and constructions; (b) removal cost; (c) losses due to the restriction of landowners’ and tenants’ rights; and (d) lost profits.

Article 12 shall be amended to add the following wording: “Indigenous peoples, communities thereof, and single persons pertaining to indigenous peoples shall have the right to compensation of damages caused to their traditional environment by economic activities of organizations and natural persons”.

This Instruction is issued on the basis of the Land Charges Act. Use of land shall carry a charge, with the following forms of payment: land tax, rent, normative price of land. The owners, holders and users of land, except leaseholders (tenants), shall be liable to an annual land tax.

The Act concerns claims enforceable by or against the Government and related civil proceedings. Subject to this Act and any other Act, all debts, damages, duties, sums of money, land, or goods, due, payable or belonging to the Government, is to be sued for and recovered by proceedings taken for that purpose in accordance with the provisions of this Act.

These Regulations amend the Radioactive Contaminated Land (Modification of Enactments) (Wales) Regulations 2006 as a consequence of the making of the Environmental Permitting (England and Wales) Regulations 2007. Regulation 5 is amended in the definitions and regulation 17 of the 2006 Regulations, providing for amendments of the Act in section 78YB of the Environmental Protection Act 1990, regarding interaction of Part 2A of the Act with other enactments.

This Act provides for the preservation of ancient and historical monuments and archaeological sites and remains.The Government will have the power to declare monuments to be protected monuments and to declare archaeological sites and remains to be protected areas. The Director may, with the sanction of the Government, purchase, take lease or assume the guardianship of any protected monument, for its protection or preservation. The Government may also enter into a written agreement with the owner of any protected monument for its maintenance and preservation.
