Plantation Ownership Act.

The present Act regulates the ownership of land where agricultural cooperatives have made plantations. Article 2 establishes that the plantations shall be an integral part of the land passing in private ownership. Article 4 deals with compensation payments. The text consists of 7 articles.

Land Acquisition Ordinance.

This Ordinance defines conditions for and sets out the procedures for the acquisition of land for public purposes. “Public purpose” is defined by this Act but a purpose may be declared as such by the Governor in Council. Whenever any land has been declared in accordance with this Ordinance to be needed for a public purpose the Governor in Council shall direct the Attorney General to take proceedings for the acquisition of the land. The Act also provides for appeal against declaration of intended acquisition, temporary occupation of land and compensation.

This Law provides rules applicable to the acquisition of land by the States through compulsory purchase on behalf of the public as authorized by Special Law, i.e. a Law confirmed by Order of Her Majesty in Council. The power under Special Law may include the right to acquire or extinguish a servitude or other right over land. Land may only be acquired on the basis of a plan approved by the States. There shall be a Board of Arbitrators for purposes of this Law, which shall determine questions as to compensation for land compulsorily acquired.


Agricultural Holdings (Improvements) (Guernsey) Law, 1965.

This Law provides rules relative to improvements made by tenants or landlords under a lease of an agricultural holding. The tenant shall in principle be entitled on the termination of the tenancy to receive compensation in accordance with the provisions of the Second Schedule, for any improvement carried out by the tenant as specified in Part I of the First Schedule or any act of husbandry carried out by the tenant on the holding as specified in Part II of the First Schedule. If the landlord carries out such improvement he or she may raise the rent according to provisions of this Law.

Ordinance implementing the Federal Expropriation Act.

The present Ordinance implements the Federal Expropriation Act of 20 June 1930. Article 1 establishes that the President of the Compensation Commission shall decide on compensation payments. Article 3 lays down provisions relating to the competent office to execute compensation payments. The text consist of 5 articles.

The present Act lays down provisions relating to the expropriation of land. Article 1 establishes that the right to property is guaranteed. Nevertheless, the Canton may acquire land or objects - if it is in the interest of the public - by means of expropriation. Article 2 lists the cases in which the competent authority may initiate expropriation proceedings.

Expropriation Law of the Canton Graubünden.

Article 1 of the present Law establishes that the compulsory transfer of property is admitted only if necessary and in the public interest; in such a case a full compensation shall be paid. The expropriation can apply to movables, immovables and rights and can be permanent or temporary In principle, expropriation of private property shall be limited to the minimum unavoidable.

The present Law lays down provisions relating to land expropriation in the Canton of Schwyz. Article 4 establishes that expropriation is, inter alia, admissible for: the rebuilding and enlargement of new streets; the remaking of river banks and brooks; for the building of new churches; the exploitation of material used for building of streets; the erection of new water conducts and fountains.
