INTRODUCTION: What is property? What do rights to property cover and what are their limits? To whom do these rights belong? In an era where everything can become a commodity, be branded, trademarked and copyrighted, disputes over property and property rights uncover tensions at every level of society, between and among different levels of the state and various social configurations, from individuals to neighborhoods and whole villages. Disputes over property are also disputes between competing social goods and values.

ABSTRACTED FROM THE FORWARD: Forced evictions frequently lead to the breakdown of community networks and informal support systems relied upon by women in their daily lives. they often mean disruption of children’s education, diminished access to health services and a deterioration of the family’s mental and physical well-being. because many victims of forced eviction are resettled in areas far from urban centres and work opportunities, husbands spend long stretches of time away from their families, leaving their wives to cope alone with daily household chores and family needs.

As Vietnam continues to search for its ideal balance between Communist control and a market-led economy, land rights emerge at the forefront of the discussion concerning the tension between traditional Socialist ideals of people-owned and state managed property versus neoliberal ideals of private property rights. The purpose of this study is twofold.

INTRODUCTION: Throughout 2012, villagers in eastern Myanmar described land confiscation and forced displacement occurring without consultation, compensation, or, often, notification. Such displacements have taken place most frequently around natural resource extraction, industry and development projects. These include hydropower dam construction, infrastructure development, logging, mining and plantation agriculture projects that are undertaken or facilitated by various civil and military State authorities, foreign and domestic companies and armed ethnic groups.

In late June and early July 2012, more than 1,000 student volunteers were dispatched to targeted provinces across the country, accompanied by officials from the Ministry of Land Management, Urban Planning and Construction (MLMUPC), to implement Cambodian Prime Minister Hun Sen’s Order 01BB. The student volunteers were trained in basic measurement techniques, kitted out with military uniforms bearing the MLMUPC’s logo, transported by army trucks, and directed to measure land and grant land certificates to rural residents.

Under the motto “old policies - new action”, in June 2012 the Cambodian Prime Minister initiated a massive land registration campaign on untitled former forest land. Unauthorised settlers and other long- term users of these lands, including those inside Economic Land Concessions, had been considered illegal before. Those of them who are poor now receive full property title by way of donation. The campaign was planned for 12 months and targets 470,000 families on 700,000 parcels comprising a total of 1,8 Mio hectares. The campaign might be extended though into the year of 2014.

ABSTRACTED FROM THE EXECUTIVE SUMMARY: Following such collection and compilation of relevant information on issues of women’s land rights, this report begins by introducing the centrality of the issue of women’s land rights, the developments in this context, and the remaining challenges with respect to complying on Articles 14, 15 and 16 of the CEDAW on the particular issue of women’s access to land and related resources. This is followed by recommendations for various key actors who are involved in ensuring the related compliance.

Through LMAP, and subsequent LASSP, Cambodia has made impressive progress in building a functioning cadastral system over the last ten years. This process has proved complex and challenging, but since commencing, the land registration teams have successfully issued over 1.7 million land titles, a strong legal framework has been developed for the functioning of the land administration bodies and mechanism, institutions have been built and strengthened, and a dispute resolution process has been established for dealing with disputes over unregistered land.

This paper investigates the real financial consequences of investing in land with disputed tenure rights. It demonstrates that companies which ignore the issue of land tenure expose themselves to substantial, and in some cases extreme, risks. Using case study analysis, the paper connects ground-up financial thinking with empirical reality. In so doing, it makes a strong case for the need to integrate tenure-related risks more comprehensively into our financial architecture.

This paper examines the main drivers of resource conflict in Myanmar. The author first looks at the major resource-related projects that could crate conflict in the country, namely the Myitsone hydroelectric dam project, the Letpadaung copper mine and the Shwe oil and gas project. He then explores some of the other areas connected to resource conflict.

In light of the increasingly volatile nature of the land conflict in Cambodia, this Report aims to describe the sources, forms and impact of the conflict throughout the country. The Report offers an overview of the land conflict throughout the country and provides recommendations to the RGC. Chapter 1 (Introduction) provides a brief overview of the status of land rights and the different ownership system throughout Cambodia’s history and of the land situation in today’s Cambodia, before discussing the scope, methodology and purpose of this Report.

INTRODUCTION: Over the years HURFOM has produced a number of accounts highlighting the hardships faced by Mon farmers who became victims of land confiscation or unjust land acquisition.1 In this report HURFOM follows-up on previously documented abuses and concentrates on an emerging new trend: farmers’ active and collective pursuits for rights to their land. Disputed Territory aims to elaborate on the activities of and express solidarity with farmers who are resolutely, and in some cases for the first time, seeking justice regarding their land.
