This Decree establishes the modalities of demarcation, restoration and determination of the boundaries of land plots and legalization thereof. It shall be compulsory for land tenants, landowners, lessees and organizations and individual entrepreneurs carrying out land survey practices. The establishment of lands plot boundaries shall be compulsory preliminary condition for land allotment.

This Ministerial Decree establishes the modalities of valuation and re-valuation of land plots by the Committee on Land Resources, Geodesy and Cartography and legal persons subordinated thereto. Valuation and re-valuation of land plots shall be carried out with the consideration of data contained in state land cadastre, land use planning register, forest register, land servitude and other use restrictions imposed by the national legislation. The results of land valuation and re-valuation shall be recorded in state land cadastre.

This Order establishes that state registration of the plots of forest land within state forest fund shall be carried out by state executive bodies responsible for keeping state forest register. State registration shall be carried out in the following cases: (a) allotment of the plots of forest land within state forest fund; and (b) renewal of lease contracts for the plots of forest land and renewal of free of charge forest management contracts in case of conformation thereof to the Forest Code.

These Regulation set out the conditions for applications for division or amalgamation of land and the requirements for the subsequent plans.

This Act provides for the consolidation of the Acts relating to the declaration of titles to land and the facilitation of its transfer, ans specifically the Real Property Act 1861, the Real Property Act Amendment Act 1878 and the Rights-of-Way Act 1881.

These Regulation set out in Schedule 1 the fees that are payable to the Registrar-General.

This Regulation establishes the Board for Lending Undivided Agricultural Lands and lays down its composition and rules of procedure. The Board’s activities are subjected to the Civil Code and to Law No. 8312 of 1998 on non-divided lands. Its tasks include the duty to continuously inform about the availability of the undivided agricultural lands; to guarantee the observation of competition rules in the land auctions; and to award the auction contracts.

The present Law implements the Law of 26 June 1974 on expropriation and seizure. This Act contains rules relative to real property and especially the lease and disposal of land.It prescribes rules relative to the manner of giving effect to equitable interests and powers, creation and disposition of equitable interests, vesting orders and dispositions of legal estates operating as conveyances by an estate owner, leasehold, rights on real property in case of infancy, lunacy or death, common ownership, registration of rights, etc.

The present Law implements the Federal Land Parcel Act of 2 August 1961 (BGBl. I, pp. 1091-1103) and Land Lease Act of 8 November 1985 (BGBl. I p. 2075). In particular, the Law lays down provisions dealing with registration, proceedings and authorization of land transactions. The text consists of 7 articles and 1 Annex.

This Order establishes the modalities of registration of the contracts of lease of immovable property (including land) except for industrial enterprises, plots of forests, separate waterbodies and perennial plants. Plots of land and other nature complexes may be allotted on lease. Expropriated land shall not be allotted on lease except for special cases envisaged by legislation. Lease contract shall be subject to state registration if not otherwise envisaged by the current legislation.
