The approval by the public of the Constitution at the referendum on August 4, 2010 and its promulgation on August 27, 2010 heralded a new dawn of governance in Kenya. Through its broad provisions, it is expected that it will spur social and economic development and secure the land rights of all Kenyans, by among others guaranteeing them ownership, control and access to natural resources.

This report, which focuses on Kenya, constitutes one of four country-wide assessments produced under the overall project. It draws on a literature review conducted by the Kenya Land Alliance (KLA) with additional inputs from IIED, as well as on primary field research conducted by KLA in April 2016 (see Section 1.2 for further information about the research methodology).

The present public land tenure management system in Kenya is fragmented, uncoordinated and non-transparent. The public land tenure as embodied in the Government Lands Act, Cap 280 of the Laws of Kenya lacks a coherent information system and is bedeviled by a lack of clarity in the roles, responsibilities and policies of different institutions in its administration, planning and disposal. Thus, there is a need for a set of national norms and standards to ensure efficient and effective use of public land as an asset in support of land reform.

For a long time the issue of land and related problems has been debated mostly by academicians, politicians and professionals. Although the problem has remained more or less one of the most talked of in Kenya, the public has very often been left out of the debate. Again mostly the debate has been dominated more by complaining about either the lack of policy or the bad land policies and laws and the failure by successive governments to correct those problems.

Cette note synthétise les présentations et les échanges qui ont eu lieu lors du séminaire dédié aux enjeux du foncier rural au Mali, organisé à l’initiative du CTFD en avril 2019.

Ces deux jours ont rassemblé une cinquantaine de participants venus du Mali et de France : des membres d’organisations de la société civile, des représentants d’organisations paysannes, des représentants de l’Office du Niger et du ministère de l’Agriculture du Mali, ainsi que des chercheurs, experts fonciers, opérateurs de projets et des membres du CTFD et des agents de l’AFD en France.

Le Groupe d’experts intergouvernemental sur l’évolution du climat (GIEC) a publié Le changement climatique et les terres émergées, un rapport spécial du GIEC sur le changement climatique, la désertification, la dégradation des terres, la gestion durable des terres, la sécurité alimentaire et les flux de gaz à effet de serre dans les écosystèmes terrestres en 2019 (www.ipcc.ch/srccl). Dans ce document, nous ferons référence au rapport du GIEC sous le nom de Rapport spécial sur le changement climatique et les terres émergées.

En Afrique rurale, la place des tensions autour de la terre et des ressources naturelles dans des conflits armés mettant en danger la sécurité nationale et parfois internationale a attiré l’attention de nombreux observateurs sur les rapports complexes entre foncier et violence politique.

L’aménagement foncier agricole, forestier et environnemental, jadis dénommé remembrement, est un mode d’aménagement du territoire ayant pour objet la restructuration foncière. Il vise la constitution d’unités de production d’un seul tenant ou à grandes parcelles, pour améliorer l’exploitation des propriétés, assurer la mise en valeur des espaces naturels ruraux et contribuer à l’aménagement du territoire communal ou intercommunal. Impliquant de nombreux acteurs, il trouve son origine au XVIIIème siècle et n’a cessé d’évoluer depuis.

Alpine pastures and meadows are agroecosystems of biological, cultural-historical, and economic importance that are undergoing profound imbalances and which are in a rapid decline due to changes in management and/or abandonment. The European Union is making efforts to protect this heritage and resource. However, the dialog among the different professionals in charge of studying and managing these agroecosystems needs to be as easy and comprehensible as possible for grasslands conservation/restoration actions to be successful.

Globally, there is growing demand for increased agricultural outputs. At the same time, the agricultural industry is expected to meet increasingly stringent environmental targets. Thus, there is an urgent pressure on the soil resource to deliver multiple functions simultaneously. The Functional Land Management framework (Schulte et al., 2014) is a conceptual tool designed to support policy making to manage soil functions to meet these multiple demands. This paper provides a first example of a practical application of the Functional Land Management concept relevant to policy stakeholders.

Most stakeholder-based research concerning agri-environmental schemes (AES) derives from work engaging with farmers and land managers. Consequently, the voices and opinions of other actors involved in AES tends to be unrepresented in the wider literature. One group of actors that seem particularly overlooked in this respect are private (independent) farm advisors (i.e., the consultants contracted by farmers and land managers to advise-on AES and agronomic matters).

Societal drivers including poverty eradication, gender equality, indigenous recognition, adequate housing, sustainable agriculture, food security, climate change response, and good governance, influence contemporary land administration design. Equally, the opportunities provided by technological development also influence design approaches. The Land Administration Domain Model (LADM) attempts to align both: the data model provides a standardised global vocabulary for land administration.
