Includes setting the scene: accountability in large-scale land acquisitions; the role of the law in shaping pathways to accountability; citizen action – how effective are the bottom-up checks and balances?; under what conditions can citizens achieve justice and equitable outcomes in relation to land acquisitions?; what role for research?

Since 2014, a set of initiatives in Cameroon, Ghana and Senegal has worked to help people harness the law in order to have greater control over decisions that affect them in a process of legal empowerment. In the three countries, the initiative developed diverse approaches, responding to different local contexts and theories of change. Each embodied a distinctive combination of grassroots action, public advocacy and private sector engagement – through supporting junior lawyers in Cameroon, grassroots committees in Ghana and locally negotiated “land charters” in Senegal.

From the mid-2000s, a commodity boom underpinned a wave of land use investments in low- and middle-income countries. While agribusiness, mining and petroleum concessions often involve promises of jobs and public revenues, they have also prompted concerns about land dispossession, exclusionary investment models and infringements of the rights of vulnerable groups. One of the major challenges is in empowering rural people to make informed choices, exercise their rights and have their voices heard.

This report draws lessons from experience of using legal processes to secure local resource rights within the context of foreign investment projects in Africa. Security of local resource rights is a major challenge in many parts of Africa. The analysis of relevant law reveals that resource rights associated with more powerful interests (foreign investment) tend to enjoy greater legal protection compared to those held by local resource users.

In many parts of Africa, legal services organisations have developed innovative ways for using legal processes to help disadvantaged groups have more secure land rights. Their approaches, tools and methods vary widely – from legal literacy training to paralegals programmes, from participatory methodologies to help local groups register their lands or negotiate with government or the private sector through to legal representation and strategic use of public interest litigation.

ABSTRACTED FROM EXECUTIVE SUMMARY: During the critical years following the 2012 land reforms undertaken in the midst of Myanmar’s political transition, Gret conducted an in-depth study combining qualitative and quantitative surveys in nine villages of Bogale and Mawlamyinegyun townships (Delta) and nine villages in Monywa and Yinmabin townships (Dry Zone). The full report and the synthesis are the result of more than two years in-depth research and 13 months of eldwork that involved an inter-disciplinary team of 11 international and Myanmar researchers.

WEBSITE INTRODUCTION: This thematic study presents a country-level overview of customary tenure arrangements in Lao PDR. It examines the extent of customary tenure and land formalization in the country, key policy changes that have impacted on customary arrangements, the degree to which customary land is recognized legally and in practice, and explores opportunities for better recognition. Customary tenure covers a wide range of land types and resources, and provides livelihood security for a majority of the Lao rural population, particularly ethnic minorities and women.

WEBSITE INTRODUCTION: This book examines large-scale land acquisitions, or ‘land grabbing’, with a focus on South-East Asia. Thematic papers and detailed case studies put this phenomenon into specific historical and institutional contexts, analysing transformations in livelihoods, human rights impacts, and potential remedies.

Cambodia has long had a difficult mix of resource wealth and weak land governance, a function of its legacy of enduring postwar conflict and neoliberal development policies of the 1990s. Since 2012, however, its government has undertaken a series of self-described ‘deep reforms’ aimed at overcoming the poverty, land conflict, and unequal rural landholdings created during the 2000s, when over 2 million hectares of economic land concessions were allocated to private companies.

WEBSITE INTRODUCTION: This paper aims to provide keys that will help us understand contemporary land dynamics in these four countries. In order to do so it highlights their similarities and differences, both in the long history that shaped today’s local land situations and in more recent reforms implemented in the context of greater economic openness. The first part of the paper sets the cultural and historical context, with an overview of the diverse ways that the political authorities and different groups within the region have related to land.

The Cambodian case examines migration, land tenure and land management, in a context of conflict and the use of force in land transfers since the time of the Khmer Rouge regime to the present, by studying five agro-ecological zones close to the Kamping Pouy irrigation system in Battambang Province. The study combines analysis of demographic and socioeconomic characteristics of household use of land and labor with a historical and ethnographic review of conflict and institutional factors in successive land administrations.
