La présente ordonnance (qui complète celle n°93-015 du 2 mars 1993 portant principes d’orientation du code rural) définit et précise les principes fondamentaux et les règles régissant le pastoralisme au Niger.Cette ordonnance consacre la mobilité des éleveurs, pasteurs nomades et transhumants comme un droit fondamental reconnu et garanti par l’Etat et les collectivités territoriales. Les modes d’accès et des droits sur les ressources foncières pastorales relevant du domaine public de l’Etat ou des collectivités territoriales sont régis par les traditions pastorales.

The document reflects a continent-wide policy initiative which aims to secure, protect and improve the lives, livelihoods and rights of African pastoralists.The framework explicitly recognizes the rights of pastoralists and the need to provide security, services, infrastructure and economic opportunities in pastoral areas which are comparable to non-pastoral areas.

This Guideline lays down the technical criteria used for the classification of pasture and meadows as well as the procedures to be followed for leasing pasture and meadow areas to individuals or private entities. The classification is used for the preparation of management plans, the update of the pasture cadaster, and the lease contracts with private users. The leasing is done in accordance with the management plans and the rules of protecting pasture ecosystems and the sustainable development of pasture resources.

The Guideline provides for areas of the public forestry and pasture fund that may be leased according to the public competition/bidding procedures. The forestry authorities assess the forestry and pasture areas at the beginning of the year and submit the proposed list of leases to the municipality together with a detailed report on their potential use. The leases should comply with the law requirements regarding the allowed activities as well as the long- and short-term management plans.

Au Niger, l’Initiative Grande Muraille Verte Sahélo-Sahélienne vise, à l’horizon 2035, le développement des communautés locales à travers une approche novatrice et inclusive consistant à mettre en synergie les actions de lutte contre la désertification, de conservation de la biodiversité, de lutte contre les changements climatiques et d’appui aux systèmes de production agro-sylvo-pastorale. La finalité étant de reverdir le Niger et de contribuer à une sécurité alimentaire durable des populations et du cheptel.

These Regulations, made in terms of section 45 of the Communal Land Reform Act, provide with respect to a wide variety of matters concerning communal land and communal land rights. Part I deals with (application for) customary land rights. It specifies the maximum size of land that may be held under customary land right and specifies particulars pertaining to allocation of customary land right.

This Act is enacted for the purposes of regulating expropriation of land, ensuring reasonable land use, safeguarding private properties and promoting public interest.
