La construcción y el mantenimiento de infraestructura en Colombia han sido definidos como una de las locomotoras de desarrollo económico del país. Esto requiere de grandes inversiones. Estudios económicos recientes en países en vía de desarrollo, como Colombia, muestran que gran parte del financiamiento de proyectos de infraestructura se logra por medio de la inversión del sector privado. De este, más de la mitad es inversión extranjera. Colombia ha adoptado recientemente una política de apertura a la inversión extranjera.
THE PROTECTION OF LAND PROPERTY IN THE INTER-AMERICAN COURT OF HUMAN RIGHTS JURISPRUDENCE AND ITS APPLICATION TO THE CASE OF COLOMBIAN RURAL COMMUNITIES
The American Convention on Human Rights embodied in an extensive way, the protection of the use and enjoyment of property, including land property. The Inter-American Court of Humans Rights has interpreted this right in an evolutionary way, according with the particular necessities of the people under the jurisdiction of the State Parties of the Convention.
Internally Displaced Persons and Indigenous Peoples: The Necessity of a Special Protection Regime
The situation of internally displaced persons (hereinafter IDPs) around the glob is getting worse by the minute. The international community has responded by creating norms that ban the actions of belligerents (during armed conflicts) and States (in times of peace) which produce the unlawful displacement of people. However, an important part of the IDPs in the Americas are Indigenous Peoples; and even though there are some specialized norms for protecting them of the displacement, those norms focus exclusively in the proprietary interest of Indigenous peoples.
