Land Policy & Legislation

The regulatory framework for land administration, land information management, planning and building consists of laws, regulations, standards, norms, and administrative procedures relating to land development that seek to determine what developers, land-owners, communities and residents are entitled to do with and on that land. Unless specified, they should apply equally to all these groups, organisations or individuals seeking to acquire, develop or transfer urban and rural land. The regulatory framework determines also the rules, responsibilities and procedures regarding the collect and the processing of land information, and land administration.

Cambodia

More than 100 families in Takeo province have been given back their land after a dispute with the Sun Hour company and an individual landholder.

The move follows protests and in front of the Ministry of Land Management as families asked the government to resolve their problems.

The 137 families were told officially on Saturday that 915 hectares in Tram Kak district’s Trapaing Kranhoung commune would be restored to them.

Indonesia
  • Indonesian President Joko Widodo last month gave several indigenous communities back the land rights to the forests they have called home for generations.
  • The total amount of customary forests relinquished to local groups under this initiative remains far short of what the government has promised, and looks unlikely to be fulfilled before the next presidential election in 2019.
  • At a recent conference in Jakarta, a senior government official said the president would sign a decree to help more communities secure rights.

  • Brazilian president Michel Temer has twice survived National Congress votes to initiate impeachment against him on extensive corruption charges.
  • Temer did so by selling out the environment, particularly the Amazon, to the ruralists who largely control the assembly.
  • Among the concessions made or promised to ruralists are presidential decrees to allow agribusiness to rent indigenous lands, forgiving unpaid environmental fines owed by landowners, and ending any enforcement of restrictions on labor “equivalent to slavery.”
