This report produced by Centre for Policy Research (CPR) a comprehensive and systematic study of Supreme Court cases on land acquisition from 1950- 2016 and examined particular conflicts involving major dams, special economic zones, housing complexes and industrial projects. It highlight the legal trajectory of land acquisition in India and attempt to provide deep understanding on how disputes over land are actually adjudicated in the Supreme Court and nature and pattern of litigation.
Modern land registration systems are usually compulsory. Countries must be able to keep track of land, ownership and land use. This is important for planning, real estate sales and urbanization. When land is properly and legally registered, it should protect landowners.
The National Land Policy (NLP) will seek to ensure that a staggered, accessible and affordable process of compulsory registration is enforced after the ratification of the policy.
Despite strong beliefs that property titling and registration will enhance credit access, empirical evidence in support of such effects remains scant. The gradual roll-out of computerization of land registry systems across Andhra Pradesh’s 387 sub-registry offices (SROs) allows us to combine quarterly administrative data on credit disbursed by all commercial banks for a 11 year period (1997-2007) aggregated to the SRO level with the date of shifting registration from manual to digital. Computerization had no credit effect in rural areas but led to increased credit-supply in urban ones.

Land Registration and Administration in Kenya is currently operated on a multi-legal platform [UN 2013]. The Land Registration Act No. 3 of 2012 (LRA) was in that regard enacted to consolidate, harmonize and rationalize land registration goals; which are yet to be achieved. This is majorly because in as much as the 2012 statute repealed five out of the seven major land registration laws, they all remain in force under LRA’s transitional clauses. The Government of Kenya is making efforts to avail land registration information online via the e-citizen platform.
In the recent past, high profile cases involving land governance problems have been thrust into the public domain. These include the case involving the grabbing of a playground belonging to Lang’ata Road Primary School in Nairobi and the tussle over a 134 acre piece of land in Karen. Land ownership and use have been a great source of conflict among communities and even families in Kenya, a situation exacerbated by corruption.
The International Land Coalition (ILC) has commissioned this present report to analyse the illegal/irregular acquisition of land by Kenya’s elites to ascertain the types of land affected, the processes used to acquire land, and the profiles of the perpetrators, as well as to identify the victims and the impacts of land grabbing.
