Under section 1 of the Act, it is lawful for an owner or operator of a mine, factory, industry or works, or a person contemplating acquiring or operating a mine, factory, industry or works, to make an agreement with the owner or lessee of any land for payment to the owner or lessee of the land of compensation for any damage or injury resulting or likely to result to the land or to its use and enjoyment. Such agreements need to be registered (sect. 3).

This Regulation specifies the conditions and procedures for obtaining compensation for any loss or damage suffered by the owner or occupant of land as a result of a board of trustees exercising its powers under the Drainage Districts Act. The Surface Rights Board is responsible for receiving applications and conducting hearings, it determines the amount of compensation and makes an order to the board of trustees to execute the payment. The Regulation also specifies which are the additional powers of the Surface Rights Board with reference to this matter (sect. 11).

This Decree sets out certain detailed rules of application for compensation and of determination of the value of the compensation for arable land, farm buildings, other real estates and assets. Certain rules of issuing of compensation bonds and financial rules regarding compensation bonds are also determined in this Decree. There are provisions also regarding the right of pre-emption of former owners of the assets, the certification and verification of former ownership. Rules of auctioning, marking out, registration of ownership of farmlands is determined as well in this Decree.

This Act provides rules for the partial compensation for damages unlawfully caused in the ownership of private persons by laws listed in Annexes 1 and 2. This Act introduces compensation bonds for the amount of compensation. Compensation bonds shall be used through the privatisation process for the acquisition of assets, shares and arable land. This Act contains special rules concerning the determination of the value of compensation for arable land and the acquisition of arable land with compensation bonds.

Iraq

This Regulation provides for compensations in kind, i.e. other land, for the alienation of agricultural land. It provides criteria for the calculation of compensation and prohibits compensation for the certain types of land. If the owner of the land does not wish a compensation in kind or compensation in kind results difficult, then the Committee established by Resolution No. 222 of 1977 may fix a compensation in cash. The intention of the Law is to allow acquisition of title to agricultural land as compensation for property loss as a result of State intervention in the past, considering the interest in continuous agricultural development as well. Article 1 lays down deadlines for the presentation of claims for agricultural land against compensation coupons. Assignment procedures for compensation coupons are covered by Articles 2 and 3. The implementation of the Law is remitted to land redistribution commissions (art. 4). Such commissions propose auction schemes and land to be sold by auction.
